NASAA Examination Validity Extension Program

Terms of Use

These Terms of Use govern your access to and participation in the North American Securities Administrators Association’s (“NASAA”) Examination Validity Extension Program (“EVEP”). By opting into the EVEP, you agree to be bound by these Terms of Use, which constitute a legally binding agreement between you and NASAA. If you do not agree with these Terms of Use, please refrain from opting into the EVEP. Please read these Terms of Use carefully before choosing to participate.

Acceptance of These Terms

These Terms of Use govern access and use of the EVEP. By accessing and opting into the EVEP, you agree that you have read, understand, and agree to these Terms of Use.

The EVEP was developed in response to the adoption by NASAA’s membership of broker-dealer agent and investment adviser representative qualification examination model rules in 2022 and 2023, respectively. These rules establish a means for eligible individuals to extend the validity of their qualification examinations in jurisdictions that adopt these rules. Successful participation in the EVEP permits eligible individuals to extend the validity of their applicable qualification examinations for up to five years from the date of their associated termination.

By opting into the EVEP, you agree that you understand that participation in the program may not extend your examination validity in all jurisdictions in which you are currently licensed or may seek to be licensed in the future. Only those jurisdictions that participate in the EVEP program (by adopting either or both of NASAA’s two EVEP model rules) will recognize the extension. Therefore, you understand it is possible that you will receive no benefit from participating in the EVEP, depending on where you seek licensure in the future. Further, you agree that you understand that participation in the EVEP does not, by itself, permit you to act in a capacity that requires registration. The program only extends examination validity and does not alone extend an individual’s licensure with a jurisdiction. In addition, you acknowledge that NASAA has no control over which jurisdictions participate in the EVEP and that jurisdictions may change their own rules to opt in – or out – of the EVEP at any time.

Copyright, Trademark, and Proprietary Information

All content, materials, logos, and trademarks displayed or made available in the EVEP (collectively referred to as the “Content”) are the intellectual property of NASAA or their respective owners. The Content is protected intellectual property and you may not reproduce, distribute, modify, transmit, display, perform, or otherwise use the Content without the prior written consent of NASAA or the respective intellectual property owner (except as otherwise may be permitted by applicable law). All rights not expressly granted herein are reserved.

Permitted Uses

The EVEP shall be used ONLY for your personal non-commercial purposes. You grant NASAA a non-exclusive, perpetual, irrevocable right and license to reproduce and distribute any information you provide NASAA as part of your use of and participation in the EVEP.

EVEP Rules of Conduct

By opting into the EVEP, you acknowledge and agree to abide by these rules of conduct. Violation of these rules may result in disciplinary action, up to and including termination of your participation in the EVEP.

You agree to:

  • Provide accurate, complete, and truthful information when opting into and participating in the EVEP.
  • Follow all conditions and instructions required for participation in the EVEP, including but not limited to the Terms of Use for participating in FINRA’s Financial Professional Gateway.
    • If opting into the EVEP to extend the validity of the Series 63 examination, you also agree to follow all conditions and instructions required for participation in FINRA’s Maintaining Qualifications Program.
  • Ensure that all records and fees are submitted according to the specified program requirements.
  • Abide by all applicable laws, regulations, and codes of conduct relevant to the profession or industry for which the associated examination qualifies you.
  • Demonstrate a commitment to ongoing professional development by fulfilling any continuing education requirements mandated by the EVEP.
  • Refrain from using the EVEP in a manner that implies a NASAA endorsement, approval, or sponsorship.
  • Refrain from using the EVEP to imply you are licensed to conduct business or to hold yourself out as such.

Disclaimers, Limitation of Liability, and Indemnification

You understand that you are participating in the EVEP at your own risk. NASAA is providing the EVEP program on an “as is” and “as available” basis, without any warranties or representations of any kind, express or implied. NASAA does not warrant that the program will be uninterrupted or error-free.

The program may include links or references to third-party websites, content, or resources. These links are provided for convenience and informational purposes only. NASAA does not endorse, control, or assume any responsibility for the accuracy, completeness, legality, or appropriateness of any third-party content. Accessing and using third-party content is done at your own discretion and risk.

To the fullest extent permitted by law, NASAA and its members, directors, officers, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, data, or other intangible losses arising out of or in connection with your participation in the EVEP (or inability to use the program) or your reliance on any information or content provided within the program. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if NASAA has been advised of the possibility of such damages.

You agree to hold harmless NASAA and its members, directors, officers, employees, agents, or representatives from and against any potential claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) brought against you by any person arising from, or in connection with, your participation in the EVEP.

By opting into the EVEP, you agree that you have read and understand these disclaimers and limitations of liability. By participating in the EVEP, you acknowledge and agree to these terms. If you do not agree with these terms, your sole remedy is to not opt in or discontinue the use of the EVEP.

Privacy

The EVEP is hosted by FINRA as NASAA’s vendor. You understand that the EVEP will be administered consistently with FINRA’s Privacy Policy found at http://www.finra.org/privacy-policy. If you are a resident of the European Union, additional EU Notices (http://www.finra.org/find/eunotices) may apply to you. 

Choice of Law

Any dispute between you and NASAA arising out of or related to your participation in the EVEP or these Terms of Use shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to conflict of law principles, and any and all claims, controversies, disputes, or causes of action shall be subject to the jurisdiction of the courts located within the District of Columbia.

Termination of Service

NASAA may terminate your right to participate in the EVEP at any time, with or without notice, for conduct that violates these Terms of Use. FINRA, as NASAA’s vendor, will terminate your participation in the EVEP when you have unsubscribed from the EVEP or have been systematically unsubscribed from the EVEP.
